1. Agreement to Terms
These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you” or “user”), and International Kids Friendly Travel - IKFT ("IKFT," "we," "us," or "our"), concerning your access to and use of our websites, including ikftravel.com, ikft.org, ikft.net, ikft.travel, internationalkidsfriendlytravel.com as well as any other media form or channel related or connected thereto (collectively, the “Site”).
By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by all of these Terms of Use. If you do not agree with all of these terms, you are expressly prohibited from using the Site and must discontinue use immediately.
These Terms of Use (the “Terms”) govern your access to and use of the websites and web services operated by IKFT (International Kids-Friendly Travel) accessible at ikftravel.com, ikft.org, ikft.net, ikft.travel, internationalkidsfriendlytravel.com and any subdomains, branded pages, directories, widgets, APIs and associated online applications (collectively, the “Website”). Please read these Terms carefully by using the Website you accept and agree to be bound by them.
If you access the Website on behalf of an entity, you represent and warrant that you have authority to bind that entity to these Terms. If you do not accept these Terms, do not access or use the Website.
IKFT (International Kids Friendly Travel) is a company registered in Malta. The Website provides informational material, public recognitions derived from public data and editorial content and describes services IKFT makes available to operators (for example the IKFT Recognized free online checks and IKFT Advisory Services (private B2B family-readiness consultancy). Use of the Website does not create a consultancy, supplier or IKFT advisory contract; separate commercial agreements govern all paid advisory services.​
1.2. Scope — website terms vs commercial agreements
1.3 These Terms regulate only your access to and use of the Website, the public directory and the informational materials published on it. They do not create, amend or replace (and are not a substitute for) any Service Agreement, IKFT Advisory Agreement, Proposal or Statement of Work between IKFT and any operator or customer.
1.4 Descriptions of IKFT offerings on the Website are for general informational purposes only. Any commitment, scheduling, scope, fees, deliverables, timelines, acceptance criteria or liabilities for professional services are set out in separate written contracts that prevail over these Terms.

2. Intellectual Property Rights
The Site and its entire contents, features, and functionality (including but not limited to all information, text, graphics, logos, icons, images, and the design, selection, and arrangement thereof) and the trademarks, service marks, and logos contained therein, including the names "IKFT", IKFT Recognized, "IKFT Advisory Services" and "IKFT Kidmetrix, are owned by IKFT, its licensors, or other providers of such material and are protected by international copyright, trademark, and other intellectual property or proprietary rights laws.
Travel providers who receive an official IKFT credential are granted a limited, non-exclusive, revocable license to display the corresponding badge in accordance with our usage guidelines. This license may be revoked by IKFT at any time.
2.1 All intellectual property rights in the Website, including trademarks, trade names, logos (including IKFT Recognized marks), databases, content, design and software are owned or licensed by IKFT. Nothing on the Website grants you any rights to use IKFT trade marks or logos except as expressly permitted in writing.
2.2 You may view, download and print extracts of content for non-commercial, personal informational use only, provided you do not remove copyright or proprietary notices. Any other use requires IKFT’s prior written permission.
2.3 IKFT Frameworks and Methodologies. The terms IKFT™ and IKFT Kidmetrix™, together with the IKFT evaluation frameworks, indicator sets, checklists, methodology documentation, and any related scoring logic published by IKFT, are proprietary to IKFT and are protected by applicable intellectual property and unfair-competition laws. You may view and reference IKFT materials for personal, non-commercial use. You may not copy, reproduce, republish, distribute, commercially exploit, or create derivative works from IKFT materials without prior written permission. Systematic extraction of IKFT content (including automated collection intended to reproduce, repackage, or commercialize IKFT materials) is not permitted. Nothing in these Terms grants you any license to use IKFT logos or badges except where IKFT has explicitly granted a badge usage license.

3. User Representations
By using the Site, you represent and warrant that: (1) you have the legal capacity and you agree to comply with these Terms of Use; (2) you will not use the Site for any illegal or unauthorized purpose; and (3) your use of the Site will not violate any applicable law or regulation.​
3.1 You must: (a) use the Website only for lawful purposes; (b) not impersonate another person or entity; (c) not bypass technical access controls; (d) not upload material that is unlawful, defamatory, pornographic, abusive or infringes rights of others; (e) not use the Website to transmit unsolicited commercial communications.
3.2 We may restrict, suspend or terminate your access to the Website for breach of these Terms or for operational, security or compliance reasons without liability.
3.3 If you register for any user account, you are responsible for maintaining the confidentiality of account credentials, and for all activity that occurs under your account.

4. Description of Services & Use of the website
IKFT provides informational content, unsolicited public recognitions, and professional assessment services related to the family-friendliness of travel providers. The information provided on the Site is for general informational purposes only.
4.1 The Website includes:
• editorial content, articles, guides and images;
• public recognitions derived from our automated desk-scans and editorial analysis (“IKFT Recognized — free online checks”); and
• descriptions of IKFT’s products and services, descriptions of IKFT Advisory Services (private B2B family-readiness consultancy, available as desk advisory, hybrid assessment, or full onsite advisory).
4.2 The content is provided for general information only and may be updated, amended or removed without notice. IKFT aims to keep material accurate but does not warrant its completeness, currency, or accuracy. You must not rely on the Website as a substitute for professional advice or due diligence.
4.3 The Website may include content provided by third parties (reviews, links, directory data). IKFT does not control third-party content and its inclusion is not an endorsement. We disclaim liability for third-party content to the fullest extent permitted by law.
4.4 Where the Website publishes “IKFT Recognized free online checks” or similar desk-based recognitions, these are public evidence-signals only. Our "IKFT Recognized™" recognitions are unsolicited opinions based on public data at the time of review. Desk recognitions (IKFT Recognized — free online checks) are not third-party verifications and reflect only the public evidence available at the time of review. They do not constitute or imply compliance with any legal, medical, or engineering standard. IKFT Advisory Services is a separate, voluntary B2B consultancy. Advisory data does not feed into the badge algorithm. Payment for advisory services does not influence badge outcomes.
4.5 IKFT may update status based on credible evidence, correction of factual errors, or Edition updates. The inaugural 2026 Edition launches in May 2026, with additional hotels and markets added on a rolling basis throughout the year. From 2027, a public hotel Edition is released each May. The IKFT Directory is the primary reference for a property’s current status (e.g., Active / Suspended / Expired). Use of any IKFT badge is a limited, revocable license. If a property’s status expires, is suspended, or is withdrawn, the travel provider must stop using the badge and remove it from marketing within a reasonable period. IKFT may disable any digital badge link or digital badge link where applicable. IKFT may update status based on credible evidence, correction of factual errors, annual Edition updates, or annual Edition updates.
4.6 Spotlight Program and discretionary recognitions (no entitlement).
IKFT may, at its sole discretion, operate discretionary initiatives (including the “IKFT Spotlight Program”) to identify, observe, or evaluate travel providers that appear to perform strongly against IKFT Kidmetrix™ indicators. Such initiatives may involve, without limitation, anonymous family style stays and onsite observation conducted by IKFT personnel or IKFT‑appointed assessors/contractors acting under IKFT standards and/or other evidence gathering steps that IKFT considers appropriate in the circumstances.
Participation is not a paid placement and does not create any right or entitlement to selection, publication, nomination, recognition, an advisory report, a badge, or continued status. IKFT may choose not to publish outcomes and may correct, update, suspend, revise, or withdraw any Spotlight content or recognition at any time (including where information is incomplete, disputed, or has changed).
For the avoidance of doubt: (a) Spotlight is an editorial/discretionary initiative and is not a service engagement unless IKFT and the relevant operator enter into a separate written agreement; and (b) any resulting IKFT Recognized badge remains governed by the standard Kidmetrix™ framework and the applicable IKFT Edition cycle.
4.7 Directory travel mode tags (e.g., Nature & Retreat, Splash & Play, City & Discovery) are indicative descriptors intended to help users filter and shortlist. They are not award tiers, guarantees, or safety certifications. Tags may change as publicly available information changes or as IKFT updates its records.

5. Prohibited Activities
You may not access or use the Site for any purpose other than that for which we make it available. Prohibited activities include, but are not limited to:
Systematically retrieving data from the Site to create or compile, directly or indirectly, a collection, database, or directory without written permission from us.
Making any unauthorized use of the Marks or Content, including for the purpose of disparaging IKFT. Engaging in unauthorized framing of or linking to the Site.

6. Site Management
We reserve the right, but not the obligation, to: (1) monitor the Site for violations of these Terms of Use; (2) take appropriate legal action against anyone who, in our sole discretion, violates the law or these Terms of Use; (3) in our sole discretion and without limitation, refuse, restrict access to, or disable any of your contributions; and (4) otherwise manage the Site in a manner designed to protect our rights and property and to facilitate the proper functioning of the Site.

7. Modifications and Interruptions
We reserve the right to change, modify, or remove the contents of the Site at any time or for any reason at our sole discretion without notice. We also reserve the right to modify or discontinue all or part of the Site without notice at any time. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Site.
7.1. Security and continuity
IKFT uses reasonable technical and organizational measures to secure the Website but does not warrant continuous, error free, or uninterrupted access. IKFT is not responsible for loss or corruption arising from attacks, outages, maintenance windows or force majeure events.

8. Governing Law
These Terms are governed by the laws of Malta, except where mandatory consumer protection laws of your country of residence apply and cannot be excluded. The courts of Malta shall have jurisdiction, without prejudice to any mandatory rights a consumer may have under applicable law.

9. Disclaimers, Liability, and Indemnification
General Disclaimer: THE SITE IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SITE AND OUR SERVICES WILL BE AT YOUR SOLE RISK. To the fullest extent permitted by law, IKFT disclaims all warranties, express or implied, regarding the Website and your use of it, including, without limitation, any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. IKFT makes no representations or warranties regarding the accuracy, completeness, or reliability of the Website’s content or any third-party content linked to it.
Disclaimer for "IKFT Recognized": OUR "IKFT RECOGNIZED" TIER IS AN UNSOLICITED OPINION OF IKFT, BASED SOLELY ON OUR ANALYSIS OF PUBLICLY AVAILABLE DATA. IT IS NOT AN ENDORSEMENT, GUARANTEE, OR WARRANTY OF QUALITY OR SAFETY. ALL TRAVEL DECISIONS MADE BASED ON INFORMATION FROM THIS SITE ARE YOUR SOLE RESPONSIBILITY.
Limitation of Liability: TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT OR LOSS OF DATA, ARISING FROM YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES..
Indemnification: You agree to indemnify and hold harmless IKFT, its affiliates, officers, agents, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of your use of the Site or breach of these Terms of Use.

THE WEBSITE, CONTENT AND ANY SERVICES ACCESSIBLE VIA THE WEBSITE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. To the fullest extent permitted by law, IKFT disclaims all warranties, express or implied, regarding the Website and your use of it, including, without limitation, any implied warranties of merchantability, fitness for a particular purpose, or non-infringement., ACCURACY, COMPLETENESS, TIMELINESS OR TITLE.
9.1 Limitation of Liability
9.2 Excluded liabilities. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IKFT, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS AND LICENSORS (THE “IKFT PARTIES”) SHALL NOT BE LIABLE FOR ANY: (a) INDIRECT, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, SPECIAL, PUNITIVE OR ENHANCED DAMAGES; (b) LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, ANTICIPATED SAVINGS, USE, DATA, OPPORTUNITY OR CONTRACTS; (c) LOSS OR CORRUPTION OF DATA, SYSTEMS OR NETWORKS; (d) DAMAGES ARISING FROM THE USE OR INABILITY TO USE THIRD-PARTY PRODUCTS OR SERVICES; OR (e) LOSS ARISING FROM THE PUBLICATION OR RELIANCE ON USER CONTENT OR THIRD-PARTY CONTENT.
9.3 Direct damages cap. SUBJECT TO CLAUSE 9.4 (MANDATORY EXCEPTIONS), THE AGGREGATE LIABILITY OF IKFT ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE WEBSITE, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, SHALL BE LIMITED TO THE GREATER OF: (A) EUR 100 (ONE HUNDRED EUROS) OR (B) AMOUNTS ACTUALLY PAID BY YOU TO IKFT IN RESPECT OF THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY. If no fees were paid (for pure Website-only claims), the cap in (A) applies.
9.4 Mandatory exceptions. Nothing in these Terms shall exclude or limit liability for (i) death or personal injury resulting from IKFT’s negligence; (ii) fraud or fraudulent misrepresentation; or (iii) any other liability that cannot be lawfully excluded by applicable Maltese law.
9.5 Allocation of risk. You agree that the exclusions, limitations and caps in this clause 9 form an essential basis of the bargain between you and IKFT and that IKFT would not make the Website available on the same terms without those limitations.
9.6 Consequential caution. You acknowledge that data on the Website may be incomplete or out of date; reliance on such data is at your own risk. IKFT cannot accept responsibility for decisions made by third parties in reliance on information published on the Website. “You should independently confirm key details directly with the relevant travel provider, property, hotel, resort, airline and cruise liner before booking or travel.”
9.7 Indemnity: You agree to indemnify, defend and hold harmless the IKFT Parties from and against any losses, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of or in connection with (a) your breach of these Terms; (b) your negligent, unlawful or fraudulent use of the Website; (c) your User Content or submissions; or (d) any third-party claim arising from your actions.
9.8 Disclaimers specific to advisory services
9.9 IKFT Recognized is a public editorial assessment based on publicly available information at the time of review. It is not certification, regulatory approval, or a guarantee of safety, quality, or personal experience.
9.10 IKFT Advisory Services (desk advisory, hybrid assessment, and full onsite advisory) are voluntary B2B consulting engagements governed by separate advisory agreements. Advisory findings are private reports and are not used as inputs to the IKFT Recognized badge algorithm. Payment for advisory services does not influence badge outcomes
9.11 IKFT does not guarantee or imply that any recognition, assessment, or advisory engagement will result in increased bookings, commercial benefit, regulatory approval, insurance advantage, or any other specific outcome. Any past performance or endorsements referenced on the Website are not guarantees of future results.

10. Links and third-party services
10.1 The Website may contain links to third-party websites and services. IKFT does not control such sites and is not responsible for their content, policies or practices. Links are provided for convenience only and do not amount to endorsement.
10.2 Where the Website integrates third-party tools (bookings, feeds, widgets), use of those tools is governed by the third party’s terms.

11. Corrections; human and automated processing.
The Website, Directory, and related materials may contain typographical errors, inaccuracies, omissions, or outdated information. Content may be produced using a combination of human review and automated tools (including technology‑assisted or AI‑assisted processing). IKFT does not warrant that any content is accurate, complete, current, or error‑free. IKFT reserves the right to correct, update, suspend, revise, or remove information (including directory entries and status indicators) at any time without prior notice.
